The term “Tim Taylor” or “www.timtaylorantiques.com” or “us” or “the seller” or “we” refers to the owner of this website.  The term “the buyer” or “the user” or “you” refers to the user or viewer of this website or the person who buys or agrees to buy the items from the seller.

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our email address at enquiries@timtaylorantiques.com and all notices from us to you will be displayed on our website from time to time.

Accuracy of Content

We have taken great care in the preparation of the content of this website, however the information may include inadvertent inaccuracies, typographical or material errors  which we will endeavour to correct as they are found.  Any weights, dimensions and capacities given about the items are approximate only.

The Contract and Conditions of Sale 

As the buyer you will need to provide us with your e-mail address which we will use to confirm your order and details.  You will be required to email us to confirm your order and details are correct.  An acceptance of your order will take place on full payment as set out on the invoice and is confirmation that you accept and adhere to the terms and conditions set out in this document.  It is the buyers responsibility to satisfy themselves they are happy with the item and condition prior to purchase.  Full payment to be received and funds cleared before delivery of an item.  Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide.  Our acceptance of your order brings into existence a legally binding contract between us. Tim Taylor reserves the right to request the buyer to present such documents to confirm buyers identity.

These conditions may not be varied except by the written permission of Tim Taylor.

Price and Payment Terms

The description of the items and the price shall be as set out in the Seller’s confirmation of order invoice.  If delivery charges are applicable this will be at the discretion of Tim Taylor, they will be specified on your invoice prior to making payment and may vary according to the type of item, size, weight and destination.

Payment in full using debit or credit card or bank transfer will be required and funds cleared before item can be delivered.  We will charge your credit account for full payment upon confirmation of your order unless delivery cannot be fulfilled.  If it is not possible to obtain full payment for the item from your account then we reserve the right to cancel the contract and or suspend the delivery to you. This does not affect any other rights we may have.

Delivery

We will only organise delivery of purchased items to the address provided to us by the buyer at the time the order was placed.  This address must also correspond with the card or bank account information used to make the payment. It is important that this address is accurate. We cannot accept any liability for any loss or damage to the items once they have been delivered in accordance with your delivery instructions. We will aim to deliver the items by the date quoted for delivery but delivery times are not guaranteed.  If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

The buyer will become the owner of the items ordered when they have been delivered to the address provided at the time the order was placed.  Once the items have been delivered, they will be held at the buyers own risk and the seller will not be liable for their loss or destruction.

Risk and Ownership

The buyer will own the items once they have been delivered and when we have received cleared payment in full, risk shall pass on delivery of the items to the buyers address.  Risk of damage to or loss of the items passes to the buyer at the time of delivery, or if you fail to take delivery at the agreed time, the time when we tried to deliver.

The seller will not be responsible for any deterioration of the item, howsoever occasioned, after risk in the item has passed to the buyer.

Cancellation Rights

In the unlikely event that you wish to return your item (with the exception of any made to order items) you will need to notify us by email (enquiries@timtaylorantiques.com) that you wish to cancel your contract. This must take place within seven days of receipt of your item.  Before you return your item you must contact Tim Taylor who will arrange collection of the item at your own cost and risk as soon as possible.  A full price refund will be issued for the item if it is returned undamaged, in the original packaging and same condition as received by you. Buyer assumes all delivery costs.  Once you have notified us that you are cancelling your contract and the item has been returned to the seller undamaged, any sum debited to us excluding delivery costs from your card or account will be re-credited to you as soon as possible and in any event within 30 days of your order.

Cancellation by us

We reserve the right to cancel the contract between us if the buyer has not adhered to the terms and conditions set out in this document.  If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your card or account as soon as possible but in any event within 30 days of your order.

Changes to Legal Notices

We reserve the right to change these terms and conditions from time to time.  It is your responsibility to look through them as often as possible as they are binding on you.

Law, Jurisdiction and Language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law.  Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales.  All contracts are concluded in English.

Disclaimer of Warranties

All representations made by Tim Taylor of any kind, express or implied as to the authenticity, attribution, description, date, age, provenance, title or condition of the item or content on this website constitute the seller’s opinion only and are not warranted by seller.  All such information, content, products, services, accuracy and completeness of the material on this website are provided “as is” without warranty of any kind for any purpose.  Any reliance you place on such information is therefore strictly at the your own risk.

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

Limitation of Liability

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase items from our site.  The importation or exportation of certain of our items to you may be prohibited by certain national laws.  We make no representation and accept no liability in respect of the export or import of the items you purchase.

Tim Taylor will not be held liable to any person for any loss or damage as a result of using this website for any purpose or for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss resulting from the use or inability to use this website.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Third Party Rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
